Non-Employee Workers (NEW’s) AKA Contract Labor Guidelines
As part of the advance preparation for assessment, the service provider must contact the facility and determine if there are any non employee workers working at the facility. If non employee workers are working at the facility, the service provider should request the number of agencies and number of NEW’s from each agency. If NEW’s comprise less than 10% and less than 50 employees, the service provider should request that the payroll and personnel information be requested from the contract employer. If not available, the auditor should proceed with standard assessment and include contract employees as partof the assessment process based on available documentation. The facility should not be cited for the NEW documentation not being available at the facility.
At facilities where the workforce are largely comprised of contracted workers hired through one or more agencies, the following guidelines apply:
1. If ONE agency is used and employs MORE than 10% of the workforce with a minimum of 50 employees:
a. The NEW workforce will NOT be included in the scope of the assessment.
b. No interviews or document review will be conducted for these workers.
c. TCCC will be notified post assessment of the facility’s use of contracted workers to determine
if a separate assessment is required.
2. If ONE agency is used and employs LESS than 10% of the workforce and less than 50 employees:
a. The workforce will be included in the assessment and any issues will be reported in the ASR
as a standard finding.
b. A proportionate number of interviews will be conducted with these worker and any issues will
be reported in the ASR as standard violation.
c. Any necessary documentation will be requested from the agency. If the agency is unable to
provide the requested documentation on the day of the assessment, the facility should not be cited.
3. If TWO OR MORE agencies are used and any one agency employs less than 10% of the workforce or
less than 50 employees:
a. Action mentioned above in (2.) will take place.
Note: All detailed reports should include a section that details for each contract agency
the agency name, the number of employees hired through the agency, and the percentage
of the total workforce contracted through the agency, the Job Function and the type of
employment (Temporary, Part-time or Full-time). If contract agencies provide NEW’s
in multiple job categories, please create a separate entry for each agency and job function.

Multiple Production Locations
If during the course of an assessment, a facility identifies a limited number of the total production buildings as being used for TCCC production, the auditor should assess the entire facility, including all production locations that are owned and operated by that supplier at that location, as one facility.
